DATA MANAGEMENT AND PRIVACY POLICY
1. GENERAL INFORMATION
This privacy policy (hereinafter, the "Privacy Policy") aims to inform the User of the means implemented by LPE to ensure the security of the collection and processing of personal data carried out via its site available at the link: https://www.lapetiteetoile.com (hereinafter, the "Site"). The Privacy Policy may be modified at any time by LPE, notably to update it in accordance with changes in current legislation and regulations, subject to notifying the User. In case of doubt, the latest version is the one appearing on the Site. It is reminded to the User that the Privacy Policy complements the T&Cs. The User agrees to read it before any navigation on the Site as well as before any data communication.
Indeed, LPE pays particular attention to the respectful processing of its Users' data and complies with Law No. 2018-493 of June 20, 2018, relating to the protection of personal data, which amended Law No. 78-17 of January 6, 1978, relating to computer science, files and freedoms, as well as Regulation (EU) 2016/679 (hereinafter, the "GDPR") relating to the protection of natural persons regarding the processing of data to
personal nature and the free movement of these data (hereinafter taken in a general manner, the « Regulation »).For the collection and processing of data under the conditions indicated herein, LPE is the data controller. The contact details of the data controller are provided in the legal notices above.
In order for the User to place an Order, the User registers on the Site and LPE requires the creation of an account necessitating the transmission of the following Data: the User's last name, first name, email address, and password. This information is strictly confidential and LPE commits to never disclose it outside of its subcontractors and service providers under the conditions defined below.
LPE informs the User that the Data found in the User's personal space are collected and processed by LPE, data controller.
2. WHAT DATA IS COLLECTED, HOW AND WHY ?
« Data » shall have the meaning provided by the Regulation, namely « any information relating to an identified or identifiable natural person; an « identifiable natural person » is considered to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more specific elements related to their physical, physiological, genetic, psychic, economic, cultural or social identity ».

The User agrees to provide only sincere, accurate, complete, and up-to-date Data and not to impersonate those of a third party.
The User is free to withdraw their consent whenever it is required. To do so, they are invited to indicate it to LPE by email at the following address: rgpd@lapetiteetoile.com. They are however informed that withdrawing their consent could prevent them from accessing certain offers and services offered by LPE.
3. HOW LONG DOES THE COMPANY LPE RETAIN THE COLLECTED DATA?
LPE informs the User that the Company retains their Data for a period not exceeding that strictly necessary for the purposes for which they were processed in the cases mentioned above, namely:
- For the Data collected while browsing the Site: so-called "cookies" Data are retained for a period not exceeding twelve (12) months from their placement on the User's device;
- For the Data collected during the User's registration on the LA PETITE ÉTOILE Site: the Data are retained for the duration of the relationship between LPE and the User;
- For the Data collected following Product Orders on the Site: the Data are retained for a period not exceeding five (5) years from the last Order;
4. WHO ARE THE RECIPIENTS OF THE COLLECTED DATA?
The recipients of the collected Data are the following: LPE, its service providers and subcontractors for the management and guarantee of the proper functioning of the Site and the delivery of orders placed on it.
For the full information of the User, LPE informs that it relies on the following subcontractors:

LPE commits to not sharing the collected Data with any third party without obtaining the User's consent, except in cases where a request comes from an authority or a state body, in compliance with the applicable Regulations.
5. WHERE ARE THE COLLECTED DATA HOSTED?
LPE informs the User that their Data are hosted by the following provider:

In the case where the User places an Order intended to be delivered outside the territory of the European Economic Area, a Data transfer may be carried out abroad to countries whose data protection laws do not provide an equivalent level of protection to that of the European Union countries. Therefore, where appropriate, we only transfer your Data to recipients offering an equivalent level of Data protection. Apart from this specific case, LPE does not transfer any of your Data outside the European Economic Area.
6. WHAT ARE THE USERS' RIGHTS OVER COLLECTED DATA?
In accordance with Articles 15, 16, 17, 18, 20, and 21 of the GDPR, the User has the following rights:
- Right of access: You have the right to obtain confirmation as to whether or not personal data concerning you is being processed, and where that is the case, to access and obtain a copy of that data.
- Right to rectification: You have the right to demand the correction of your personal data if you believe it is inaccurate or incomplete.

The user, in order to exercise their rights, must provide LPE with:
- The origin of the data collection (via the Site, during an order, during the submission of an article..) ;
- Their identity and contact information ;
- A proof of their identity.
LPE has a period of one (1) month from the receipt of the request to respond, subject to its legitimacy and non-excessiveness. LPE may retain data related to identity documents, from receipt of these documents, for one year for exercising the right of access and for three years for exercising the right of objection.
The user can also at any time refuse that their data be used by LPE or its partners for sending advertising offers or other marketing purposes.
The user is informed that they can, if they believe their rights have not been respected, file a complaint with the National Commission on Informatics and Liberty (hereafter, the “CNIL”). MANAGEMENT OF COOKIES
A "cookie" is a file text placed by LPE and its partners on the User's device during their browsing on the Site. The cookie records information related to the User's navigation on the Site, and stores information that the User has entered during their visit. Thus, the User will not need to re-enter them during their next visit. We will be able to consult them during your future visits.

Through this Site, the User may access other sites, designed and managed under the responsibility of third parties. The User is informed that LPE exercises no control over the content of these sites. Furthermore, LPE declines all responsibility regarding, in particular, their content and the use that any third party may make of the information contained therein.
INTEGRITY - TECHNICAL FAILURES – DATA LEAKS
LPE reserves the right to temporarily interrupt access to the Site to carry out technical interventions, improvements, and maintenance of the Site to ensure its proper functioning or to repair a malfunction.
The User is informed that the security and integrity of communications on the Internet cannot be guaranteed. LPE commits to making its best efforts to notify the User of any difficulty accessing the site or any interruption of the Site's broadcast, without any obligation of result.
In the event of a personal data breach, LPE notifies the breach it has suffered to the CNIL as soon as possible. If the personal data breach is likely to result in a high risk to the rights and freedoms of a Client, LPE informs the individual concerned by the personal data breach as soon as possible.
LAW AND JURISDICTION TERRITORY
The applicable law is French law, and the competent courts are the French courts in accordance with the rules of the Code of Civil Procedure.
